These are the main requirements for visas requiring proof of notability

Extraordinary Achievement

Individuals with extraordinary abilities in fields such as the sciences, arts, education, business, or athletics can qualify for temporary work in the United States under the O-1 or O-2 visa classifications.

These visas are designed for individuals and their essential support personnel to contribute significantly to their fields while working in the U.S.

Evidence

It is crucial that evidence not only satisfies specific criteria but also collectively demonstrates sustained acclaim and recognition in the applicant’s field of expertise.

For O-1 applicants, this evidence should establish their extraordinary ability and intentions to continue working in their field while substantially benefiting the U.S. For O-2 applicants, evidence should focus on their indispensable support role.

Notability (ie publicity!)

This is the tough bit that most struggle with (although this is the crux of our service). Being notable means your account name represents a “well-known, highly searched for” person. 

We write stories and have your lawyer sign them off to ensure they satisfy the high bar of the O-1 & O-2 Extraordinary Ability visa classes.  If you are simply an unnamed member of a team whose work was mentioned in a publication, it will not be highly considered.

Processing Time

USCIS processing times for both O-1 and O-2 visas typically range from 3 to 12 months. We recommend starting a publicity campaign 1-6 months prior to your target submission date. 

While there is no specified minimum number of publications required for O-1 applicants, having at least three (3) well-cited publications can strengthen an application significantly.

Providing Extraordinary Ability for the purposes of Visa Applications

For the O-1 visa, applicants must demonstrate sustained national or international acclaim and prove their expertise places them at the very top of their field. The U.S. Citizenship and Immigration Services (USCIS) defines “extraordinary ability” as possessing a level of expertise that is widely recognized through significant achievements and acclaim. Applicants must either have received a major internationally recognized award (e.g., an Olympic medal or Academy Award) or meet at least three of the following criteria:

  • Receipt of nationally or internationally recognized awards for excellence.

  • Membership in associations requiring outstanding achievements.

  • Published material about their work in major media or professional publications.

  • Participation as a judge of others’ work in the same field.

  • Original contributions of major significance to the field.

  • Authorship of scholarly articles or publications.

  • Employment in a critical role for distinguished organizations.

  • Commanding a high salary or remuneration for services.

For the O-2 visa, applicants must demonstrate their role is essential to the success of an O-1 visa holder’s work. This includes possessing unique skills and experience not readily available from U.S. workers and, in some cases, having a longstanding working relationship with the O-1 holder.

Published Material about you in professional or other major media publications

For O-1 & O-2 classifications, published material must be in professional or major trade publications or other major media and specifically relate to the beneficiary’s work in their field to count towards the application. Marketing materials or unevaluated listings are not considered valid. 

Evidence submitted to USCIS must include the title, date, author, circulation data, and audience of the publication, proving the material’s focus on the beneficiary’s contributions to their field. This evidence must be tailored to the publication’s medium, whether online or in print, ensuring it highlights the beneficiary’s work rather than their employer or associated organizations.

Many types of publicity do not count as “published material”.

Marketing materials created for the purpose of selling the beneficiary’s products or promoting the beneficiary’s services are NOT generally considered to be published material about the beneficiary.

Unevaluated listings in a subject matter index or footnote, or reference to the beneficiary’s work without evaluation are insufficient.

The material must be published in recognized professional, trade publications, or other major media outlets that are relevant to the beneficiary's field of endeavor.

Focus on Your Work

The content must specifically relate to and highlight the beneficiary's own contributions, achievements, and work within their field, rather than general marketing or promotional content for their products or services.

Documented Evidence of Circulation and Audience

There must be clear evidence regarding the publication's circulation (both online and in print) and the intended audience, demonstrating that the material reaches a significant and relevant readership.

What happens if I fail ?

You can try and try again. We can continue to publish news stories until you succeed. 

Unless it is expressly outlined in your denial or rejection letter, there is nothing preventing you from re-filing your petition. This is a simple solution that is most effective when the rejection was due to a simple information or payment error.

Unfortunately, you will still need to go through the processing time and pay the filing fees again.

However, if your petition was denied on account of your criminal record or your qualifications, simply refiling will most likely only end in being denied again. You and your attorney would need to present new evidence showing that your circumstances have changed in order to have a chance at approval.

How does the writing process work?

We have a team of highly credentialed and experienced writers and editors, however sometimes aligning expectations between our team and your brand causes friction. We send a questionnaire after payment is received to give us some background about what you want us to write, how you want it written and we will try our best in every case.

What will you write about?

Our clients usually pick an attention grabbing topic about their business. If you’re not sure, you can always reach out to us for help. We have a great team that have experience in getting more eyeballs onto articles. 

What happens if I don't like what you write?

This happens from time to time, and the solution is always to simply let us know the changes you want to the news story by communicating them directly to us. We will always share the news stories with you in an editable format. You are free to change the article, make edits or change links as you like.

Can i request that you rewrite my news story?

Our writing service is limited to one draft and one round of edits for each news story. If you want us to start again, fees apply. Please note that if you rewrite the article, or insert changes directly into the article, you will not be charged anything further.

Will every article you write rank in Google?

No. Each article appears on 50-60 websites, so usually only 1 news story will rank in Google News (the most common is Digital Journal, although others rank in Google News as well, but it depends on the way Google search works in your jurisdiction). There are strategies to help get multiple links to rank in Google, but you will need to integrate the links and logos into your website in a search engine friendly manner. We can advise on this after you receive our press publication report.

What are the article guidelines?
1) The title of your press release should be minimum 6-8 words (excluding prepositions and articles).
 
Here the guidelines in writing the headline for reference:

– The headline must include the company’s name or the name of the spokesperson / author.  
– The headline can’t contain personal pronouns (I, Me, My, We, Us, Our, You, Your, Them, Their, etc.). 
– The headline can’t contain an exclamation point.- The headline should be a minimum 6-8 words (excluding prepositions and articles)
– The headline can’t contain quotes.
– The headline should not sound like the headline of an advert. Discounts/pricing details and product specifications can be added in the Sub headline or article’s body.

2) The article can’t be written in the first or second person voice. First person (I, Me, My, We, Us, Our, etc.) and second person (You, Your, etc.) voices are not considered newsworthy, except in quotations.

3) The articles cannot mention BadenBower in the headline or body copy or denigrate our reputation or good-standing. 

How long does this process of publication?

Its quick. If you give us your article, it is usually 2-5 business days. If we write the article, it can be 2-10 business days. 

Will I be able to search for the news stories on the websites where you publish?

You will have a report that contains the logo of each website (ie Apple News, Marketwatch, Fox etc) along with the relevant link, but please note our service is paid promotion and the websites usually prevent users from searching for the articles themselves without having a direct link to the article. What most customers do is link the logos and articles from their homepage, landing pages, contact page and social media to increase trust and credibility and this is what we recommend you do too.

How am I billed for your services?

By credit card, wire transfer or EFT. News stories are charged monthly, although you can cancel anytime before the next billing period. There are no lock-in contracts. 

Do the articles stay published forever?

Articles usually stay up for months or years, but in some cases publishers decide to remove them after publication. Provided we succeed in publishing your news story, there will be no refund if the story is removed

Refund Policy

Refunds are only considered if we are unable to fulfill our contractual obligation to publish your news story or stories.

If, after making a good faith effort to work with you to produce an article, you have not provided sign-off or failed to provide any necessary edits within 7 days of a draft article being submitted to you, then no refund will be issued.

In the event that we engage with you in good faith, and you withhold information about your business or person which leads to a publication not publishing due to an active criminal or civil case which was not known to us at the time of engagement, we will make reasonable efforts to publish your story on alternate news sites that are more tolerant of companies and individuals before the courts. In such a case, you are not entitled to a refund, but we will use our best efforts to publish the number of news stories purchased on alternate news sites. We will not refund if you ask us to defame a person or company after making payment. 

Monthly subscriptions are non-refundable unless cancelled prior to the next billing date and must be cancelled prior to your next billing date in order to avoid being charged. If a cancellation is not received before the next billing date, no refund will be issued. If the subscription is cancelled, no refunds will be issued for any partial membership periods or unused article credits but we will honour all the deliverables based on whatever option you purchase.

Refunds will not be provided for accidental purchases, medical conditions which prevent you from engaging with us or publishing articles after payment, or any similar reason or event.
